These Terms of Use ("Terms") govern your access to and use of Aperta, a location-based social media application developed by Cirque Media LLC. By accessing or using Aperta, including browsing or creating an account, you agree to be bound by these Terms and our Privacy Policy.

1. Eligibility

You must be at least 18 years old to use Aperta. If you are under 18, do not use the Service.

2. User Accounts

You are responsible for safeguarding your account credentials. You may delete your account at any time through in-app settings. Account deletion is fully self-service and does not require contacting support.

3. Your Content

You retain ownership of content you upload. By posting content, you grant Cirque Media LLC a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content solely in connection with operating and promoting the Service. You may not post content that violates any law or infringes upon the rights of any third party.

5. Content Moderation & Community Safety

Aperta maintains content moderation practices and user safety tools intended to promote a respectful and safe community environment. While we strive to address harmful or inappropriate content, we do not guarantee that all content will be reviewed immediately or removed.

Design-Based Moderation

Aperta is designed to reduce harmful or unwanted content through platform design and user controls. Content visibility may change naturally over time due to limited engagement, user preferences, expiration, or filtering choices. Users can influence their experience through tools such as blocking, snoozing, hiding posts, and content filters.

These design elements help promote a healthier experience but do not replace human review. Cirque Media LLC retains full discretion to moderate, restrict, or remove content or accounts as necessary to maintain community standards.

Users may report content or accounts through in-app tools. Reports are reviewed on a best-effort basis and addressed within a reasonable timeframe depending on report volume, severity, and available resources. Cirque Media LLC reserves discretion in determining appropriate responses.

5.4 Temporary Visibility Restrictions

Content that receives multiple reports or raises safety concerns may be temporarily hidden from public view pending review. Such actions do not constitute permanent removal and are subject to further evaluation.

5.5 Enforcement Actions

Depending on severity or recurrence, enforcement actions may include content removal, account warnings, temporary suspension, permanent suspension, or referral to appropriate authorities.

6. Location Use

Approximate GIS coordinates are stored with posts for location-based filtering. Location data is intentionally imprecise, not publicly shared, and not used to identify users.

7. Paid Features

Aperta is currently free to use. Cirque Media LLC may introduce optional paid features, subscriptions, or credits in the future. Any such features will be clearly disclosed and may be subject to additional terms.

8. Intellectual Property

Cirque Media LLC retains all rights to the app’s design, branding, features, and underlying technology.

9. Termination

We may suspend or terminate access to the Service for violations of these Terms or misuse of the platform. Suspension may limit or remove access to app features.

10. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind. We do not guarantee availability, reliability, or uninterrupted operation.

11. Limitation of Liability

To the maximum extent permitted by law, Cirque Media LLC shall not be liable for indirect, incidental, or consequential damages. Total liability shall not exceed the amount paid through the app, if any, or $100, whichever is less.

12. Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service constitutes acceptance of any updated Terms.
